These Terms of Use govern your access to and use of Hail Ping, including hailping.com, storm reports, paid reports, maps, data, accounts, emails, alerts, and related services.

Hail Ping is operated by Storm Digital. By using Hail Ping, creating an account, purchasing a report, or accessing any content, you agree to these Terms of Use.

1. Use of Hail Ping

Hail Ping provides hail storm reports, market intelligence, estimated repair opportunity data, maps, and related information for business planning and informational use.

You may use Hail Ping only for lawful purposes and only in accordance with these Terms.

2. Accounts

Some features may require an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

You agree to provide accurate information and keep your account information current.

You may not share, sell, transfer, or sublicense account access unless Storm Digital gives written permission.

We may suspend or terminate accounts that violate these Terms, abuse the service, attempt unauthorized access, scrape data, or create risk for Hail Ping, Storm Digital, users, systems, or data providers.

3. Paid Reports and Purchases

Hail Ping may offer paid storm reports, subscriptions, account upgrades, or other paid access.

Prices, features, and availability may change at any time.

Payments may be processed by third-party payment processors such as Stripe. By making a purchase, you agree to the payment terms shown at checkout and any applicable third-party payment processor terms.

Unless a separate refund policy says otherwise or applicable law requires a refund, purchases for digital reports are final once access is provided.

If subscription billing is offered, your subscription may renew automatically until canceled. You are responsible for canceling before the renewal date if you do not want to be charged again.

4. Report Access and License

When you access free or paid Hail Ping content, Storm Digital grants you a limited, revocable, non-exclusive, non-transferable license to use that content for your own internal business or personal use.

You may not copy, resell, redistribute, republish, scrape, bulk download, sublicense, or commercially exploit Hail Ping reports, data, maps, scoring, layouts, or outputs without written permission from Storm Digital.

5. Prohibited Uses

You agree not to:

  • Use Hail Ping for unlawful, fraudulent, misleading, or abusive purposes.
  • Use Hail Ping as an emergency warning system or official weather source.
  • Scrape, crawl, harvest, copy, or bulk export data from Hail Ping.
  • Reverse engineer, decompile, interfere with, or attempt to access non-public parts of the service.
  • Share paid report access publicly or with unauthorized users.
  • Attempt to bypass paywalls, account limits, rate limits, or security controls.
  • Upload malware or interfere with the performance or security of Hail Ping.
  • Use Hail Ping in a way that violates third-party rights, laws, regulations, or data provider terms.

6. Weather, Market, and Business Data

Hail Ping may include storm reports, hail size information, radar data, maps, business listings, repair competition data, population data, vehicle estimates, claim estimates, opportunity scores, and related analysis.

This data may be estimated, delayed, incomplete, inaccurate, or subject to change. Hail Ping does not guarantee that any storm caused damage, that any repair opportunity exists, or that any business outcome will occur.

You are responsible for independently verifying information before making business, travel, staffing, marketing, safety, or operational decisions.

7. No Emergency Use

Hail Ping is not an emergency alert system, official warning source, public safety tool, or substitute for official weather information.

For emergency weather information, use official sources such as the National Weather Service, NOAA, local emergency management, and local authorities.

8. Intellectual Property

Hail Ping, including its name, website, reports, layouts, scoring systems, written content, graphics, maps, design, software, and other materials, is owned by Storm Digital or its licensors and is protected by intellectual property laws.

You may not use Hail Ping branding, content, reports, or data except as allowed by these Terms or with written permission from Storm Digital.

9. Third-Party Services

Hail Ping may use or link to third-party services, including payment processors, hosting providers, analytics providers, mapping tools, data providers, and external websites.

Storm Digital is not responsible for third-party services, content, data, availability, security, or privacy practices.

10. Service Availability

We may modify, suspend, limit, or discontinue any part of Hail Ping at any time. We do not guarantee uninterrupted access, error-free operation, or continued availability of any report, feature, dataset, map, account, or service.

11. United States Only

Hail Ping is intended only for users located in the United States.

You may not use Hail Ping if you are located outside the United States or if your use would subject Hail Ping or Storm Digital to non-U.S. privacy, consumer protection, data protection, or regulatory requirements.

Storm Digital may block, restrict, suspend, or terminate access from locations outside the United States at any time.

12. Disclaimer of Warranties

Hail Ping is provided "as is" and "as available."

To the fullest extent permitted by law, Storm Digital disclaims all warranties, express or implied, including warranties of accuracy, completeness, reliability, merchantability, fitness for a particular purpose, non-infringement, availability, and suitability for any business decision.

13. Limitation of Liability

To the fullest extent permitted by law, Storm Digital will not be liable for any indirect, incidental, consequential, special, exemplary, lost profit, lost revenue, lost opportunity, business interruption, data loss, or other damages related to your use of Hail Ping.

To the fullest extent permitted by law, Storm Digital's total liability for any claim related to Hail Ping will not exceed the amount you paid to Storm Digital for Hail Ping access in the 3 months before the claim arose.

14. Indemnification

You agree to defend, indemnify, and hold harmless Storm Digital from claims, damages, losses, liabilities, costs, and expenses arising from your use of Hail Ping, your violation of these Terms, your violation of law, or your misuse of any report, data, map, or recommendation.

15. Termination

We may suspend or terminate your access to Hail Ping at any time if we believe you violated these Terms, created risk, misused the service, or used Hail Ping in a way that could harm Storm Digital, users, systems, or data providers.

16. Governing Law

These Terms are governed by the laws of the State of Ohio, without regard to conflict of law rules. Any dispute related to these Terms or Hail Ping will be handled in the state or federal courts located in Ohio, unless applicable law requires otherwise.

17. Changes to These Terms

We may update these Terms at any time. The updated version will be posted on this page with a new "Last updated" date. Continued use of Hail Ping after changes are posted means you accept the updated Terms.
